Rusty Tucker is a member of the Real Estate Team. His practice involves providing strategic advice and support to clients navigating the acquisition, disposition, financing, leasing, and development of real estate assets across the United States.
Rusty advises clients in a variety of real estate transactions, including the acquisition, disposition, financing, leasing, and development of real estate across multiple asset classes. He also conducts title and survey examinations, ensuring that his clients’ interests are protected and potential issues are identified and addressed proactively.
Additionally, Rusty is well-versed in drafting, reviewing, and negotiating a wide array of complex real estate contracts and agreements with an emphasis on purchase and sale agreements, ground leases, space leases, operating agreements, assignments, deeds, amendments, development agreements, declarations of restrictive covenants, license agreements, easements, rights-of-way, and subordination, non-disturbance and attornment agreements. He ensures his clients’ rights and obligations are clearly defined, and their interests are safeguarded throughout every stage of a deal.
Rusty’s representative experience includes:
- Represented a publicly traded quick service restaurant, as tenant, in negotiating ground leases and developing its leased properties throughout the United States.
- Represented a buyer/landlord in negotiating a leaseback to the seller/tenant with its acquisition of improved land.
- Represented both landlords and tenants in negotiating triple net retail leases in shopping centers throughout the United States.
- Represented both landlords and tenants in negotiating space office leases throughout the United States.
- Represented landlord in negotiating a modified gross office lease in the space located beneath its multifamily housing building in Las Vegas, Nevada.
- Assisted in the representation of an investment company with its acquisition of a portfolio of 8 retail drug stores located in California, Florida, Illinois, Tennessee, Texas, and Wisconsin for approximately $40 million.
- Assisted in the representation of a multi-family development company, as landlord, in negotiating an office lease in the space located beneath its multi-family housing building in Las Vegas, Nevada.
- Assisted in the representation of a development company in its disposition upon completion of phase I construction of a fully-permitted and entitled self-storage development project in Santa Clarita, California for over $11 million.
- Assisted in the representation of a development company in its disposition, upon completion of construction of a self-storage facility, of 100% of the LLC membership interests of the property owner in Henderson, Nevada for approximately $30 million.
- Assisted in the representation of a development company with its acquisition of a portfolio of 3 self-storage facilities located in the Dallas-Fort Worth metroplex for approximately $37 million.
- Assisted in the representation of a developer in its acquisition of the office unit of a mixed-use condominium in Dallas and the transfer of declarant rights for approximately $115 million.
- Assisted in the representation of a multi-family/student housing development company with its acquisition, development, debt financing, preferred equity financing, and disposition of multiple properties throughout the United States.
Away from the Office
In his free time, Rusty enjoys spending time with his wife and 3-year-old son and cheering on Dallas' local sports teams.
