Kane Russell Coleman & Logan PC Wins Summary Judgment in Non-Compete Case

Bill Pilat and Kevin Riley, attorneys in the Houston office of Kane Russell Coleman & Logan PC, successfully defended a geoscience company specializing in offshore projects in a covenant not to compete suit.

According to court documents, in 2013 a geologist resigned from her position at a geoscience company and accepted an offer at a competing firm.  Her previous employer immediately filed suit, seeking a temporary injunction and suing the geologist for breach of the non-compete clause she executed when joining the company five years earlier.  The Plaintiff also sued the geologists’ new company for tortious interference relating to the covenant not to compete, misappropriation of trade secrets, and for inducing her to breach her fiduciary duty.

In June 2013, after taking live testimony over the course of three days, the district court denied the Plaintiff’s application for a temporary injunction.  Subsequently, on February 7, 2014, the district court granted the Defendants’ motion for summary judgment and dismissed the claims against both the geologist and her new employer.
