LITIGATION ALERT: SOCIAL/ELECTRONIC MEDIA AND THE RULES OF EVIDENCE

Whether it is text messages, e-mails, website postings, "Twitter®" or Facebook®, the concept of in-person communication has rapidly been replaced by impersonal electronic modes of communication.  Practically everything we do on a daily basis is memorialized in some electronic form.  Not only has this ever-changing world of communication had a significant impact on how business is conducted, but it has also affected the legal profession.  Litigation attorneys must quickly adapt to the impact of social media, email and the internet, both for use at  trial as evidence, and in the requirements for admissibility.
