National Trucking Company Obtains Defense Verdict in Multi-vehicle Accident Case

KRCL attorneys Aaron Speer and Zach Mayer successfully defended a national trucking company in a case involving a multi-vehicle accident on a major urban highway in Dallas, Texas. Plaintiff’s vehicle was struck by a tractor trailer operated by an employee of the national carrier. Plaintiff’s vehicle spun across three lanes of traffic and crashed into the concrete median. Plaintiff’s attorney argued the Defendant was not aware of its surroundings, failed to maintain its lane and recklessly struck Plaintiff’s vehicle on the passenger side.

Plaintiff’s counsel introduced the testimony of a chiropractor to support their claimed damages of $410,000. As a result of the collision, Plaintiff aggravated a serious back injury, resulting in ESI injections and months of therapy.  Additionally, Plaintiff aggravated a prior neck fusion, an injured shoulder and sustained a torn meniscus in his knee. Plaintiff testified that he was no longer able to run his construction business or work at the restaurant he owned, and that his children were now having to operate his businesses for him.

At the conclusion of the 3-day jury trial, the jury returned a complete defense verdict, and apportioned no responsibility to the client.  Instead, the jury assigned 100% of the responsibility for the accident to the other vehicle, even though it never contacted Plaintiff’s vehicle and the driver was not present at the trial.
