Brett Holubeck is Board Certified in Labor and Employment Law and focuses his practice on defending and advising employers in a wide range of workplace matters, including discrimination, wage and hour, noncompetition, and labor relations issues. He works closely with clients to provide strategic legal guidance through complex employment matters.

Brett has extensive experience managing employment matters at every stage - from day-to-day counseling through litigation, arbitration, and agency proceedings. His work includes drafting motions, briefs, employment agreements, and statements of position; attending hearings; negotiating settlements; and advising employers on compliance and risk mitigation. He has successfully argued dispositive motions, including a motion for summary judgment that prompted the plaintiff to amend their complaint and a motion to dismiss that resulted in the full dismissal of all claims. From day-to-day counseling to high-stakes litigation, Brett provides strategic guidance tailored to each client’s operational and business objectives.

In addition to defending claims, Brett helps employers prevent them. He regularly conducts and leads internal investigations involving allegations of sexual harassment, disability and race discrimination, unfair labor practices, and workplace safety issues, providing strategic recommendations aligned with each client’s legal and business objectives.

His practice also includes representing employers before administrative agencies such as the EEOC, NLRB, and OSHA, where he has achieved early resolution in numerous matters and helped minimize potential penalties through proactive compliance counseling and federal inspection representation.

In addition, Brett advises on union-related matters, including organizing campaigns, strikes, picketing, and collective bargaining, as well as drafts and reviews employment policies and agreements such as noncompete and arbitration agreements, executive compensation plans, employee handbooks, and AI workplace policies.

A frequent presenter at industry and human resources events, Brett provides employers with practical insights on labor, employment, and workplace safety topics. He also offers strategic counsel focused on supporting HR and operational leaders in navigating federal, state, and local employment law requirements.

Beyond his legal practice, Brett authored a labor and employment law blog dedicated to delivering actionable guidance for HR professionals, managers, and business owners, and produced a podcast in 2021 and 2022. His thought leadership has been recognized with the LexBlog Excellence Award (2019) for Best “How-To” Post.

Away from the Office 

Outside the office, Brett enjoys spending time with his wife and children. He is an avid reader, enjoys attending concerts with his wife, and can often be found grilling in the backyard whenever the Texas weather cooperates.
