LITIGATION ALERT: CLASS ACTIONS OVER OVERDRAFT FEES

No one wants to suffer the embarrassment and inconvenience of their bank rejecting a debit card transaction due to insufficient funds. To alleviate embarrassment, banks often provide customers with courtesy overdraft protection.  Through that protection, the bank pays an item presented to a customer's account despite insufficient funds in exchange for an overdraft fee. Consumer rights advocates question the practice alleging that it improperly depletes customers' available funds in order to maximize the overdraft fee collection by banks.  These issues are prominent features not only in litigation but also in recent legislation.
